Donald Trump is NOT Eligible to Be President - The 14th Amendment, Section Three

In this Podcast Episode, I quote from “The Sweep and Force of Section Three," written by two law professors, William Baude and Michael Stokes Paulsen. The "Section Three" that is in the title is from the 14th Amendment to the U.S. Constitution. The Professors are Constitutional experts and members of the Conservative Federalist Society. They conclude that "Donal Trump is not eligible to hold the office of the Presidency.

 "At all events, if a President or former President of the United States; a current or former officer of the federal executive branch; a Member or former Member of Congress; a current or former state legislator or state executive official; or a current or former federal or state court judge, planned, supported, assisted, encouraged, endorsed, or aided in a material way those who engaged in the insurrection of January 6, or otherwise knowingly and willfully participated in a broader rebellion against the constitutional system, such persons are constitutionally disqualified from office. In such situations, Section Three’s constitutional disqualifications can, should, and must be carried out."

Of all of the Georgia 18 and all the charges, the three that hit me in the gut were the defendants charged with harassing election workers, Ruby Freeman and her daughter Shay Moss.

After all my years of working with election officials and covering election day stories, the Election Worker holds a special place in the democratic process and my heart.

It's a thankless job, but thank goodness they do it.

The horror stories Freeman and Moss told to the January 6 Committee were heartbreaking.

The two Georgia Women were wrongly accused by Donald Trump and Rudy Giuliani of stuffing ballot boxes and passing around illegal USB Drives. 

Then the death threats followed. Giuliani has already admitted, under oath, that he has NO Evidence that they did anything wrong.

Harrison Floyd, Trevian Kutti, and Stephen Lee are three people who attempted to confront the two election workers physically.

The trio are accused of Racketeering, Conspiracy to Commit Solicitation of False Statements and Writings, and Influencing Witnesses. Lee is also accused of Criminal Attempt to Commit Influencing Witnesses and Criminal Attempt to Commit Influencing Witnesses.

Of course, they are innocent until proven guilty.

TRUMP - 18 ALLIES INDICTED IN GEORGIA

A Grand Jury in Georgia indicted Donald Trump and 18 of his allies late Monday night.

The former president and 18 other people who worked for him or supported him were charged with engaging in a ‘criminal enterprise’ to illegally overturn the results of the 2020 election in the state of Georgia.

It is the fourth indictment of Trump this year - an unprecedented political and legal situation.

It is a massive 98-page Criminal Indictment.

Trump tops the list of other defendants, but here are some stand-outs. He has been charged with 13 felony counts. 

The criminal charges vary from defendant to defendant.

We begin with former New York Mayor Rudolph Giuliani and former White House Chief of Staff Mark Meadows.

Kenneth Chesebro and John Eastman, architects of the plan to use fake Trump electors to circumvent the popular vote, and Jeffrey Clark, a former senior official in the Department of Justice who embraced false claims about the election.

This is the text from pages 13-14 of the Indictment:

"Defendant Donald John Trump lost the United States presidential election held on November 3, 2020. One of the states he lost was Georgia. Trump and the other Defendants charged in this Indictment refused to accept that Trump lost, and they knowingly and willfully joined a conspiracy to unlawfully change the outcome of the election in favor of Trump. That conspiracy contained a common plan and purpose to commit two or more acts of racketeering activity in Fulton County, Georgia, elsewhere in the State of Georgia, and in other states."

 

Other lawyers who aided Trump’s efforts and were indicted include Sidney Powell and Jenna Ellis.

EXPLAINING GEORGIA - THE TRUMP ELECTION INTERFERENCE CASE

Here is what we know:

Two Georgia Grand Juries are meeting in Atlanta this coming week, August 14 - August 18. 

Witnesses have been subpeoned to testify. 

Fulton County District Attorney Fani Willis has made it clear she is ready to bring her case to the Grand Jury.

We also know that the forewoman of the Special Grand Jury has said that there will be multiple indictments. And those indicted are "Well-Known." 

At least 20 people have been informed that they are "targets" of the Georgia Investigation. 

DA Willis needs two days to present her case. Then the Grand Jury will vote.

That vote will determine if former President Donald Trump will face a 4th Criminal Indictment.

This is the headline in The Washington Post on July 14, 2023,

"Neither Trump nor DeSantis will get the GOP Nomination."

HE HAS THE RIGHT TO REMAIN SILENT - TRUMP’S WEEKEND RANTS

Trump has the right to remain silent. But it's not happening. Quite the opposite. 

Here is a chronological account of the Protective Order Mini-Saga that began at Trump's Arraignment.

On Thursday:

When Trump was arraigned, the Judge Magistrate told him this. “It is a crime to try to influence a juror or to threaten or attempt to bribe a witness or any other person who may have information about your case, or to retaliate against anyone for providing information about your case to the prosecution, or to otherwise obstruct the administration of justice,” she said.

The judge added a warning that if he violated the conditions of release, “You may be held pending trial in this case.”

She then asked him: “Do you understand these warnings and consequences, sir?”

Trump responded, “Yes.”

On Friday, Trump posted, in caps, 'YOU GO AFTER ME, I GO AFTER YOU?"

DOJ then requested a protective order.

Trump's people say the post was meant for political rivals.

Federal Judge Tanya S. Chutkan set a Monday Deadline for Trump's attorneys to respond in court.

Trumps attorney's did respond. Then Jack Smith responded to that response.

The Judge wants to see them in the next couple of days.

Background:

Special Counsel Jack Smith requested a protective order before Trump's post. Trumps attorney's objected. This may be why the judge issued the warning.

During the discovery phase of the Trial, the Trump Team will have access to witness lists and testimony. The protective order is for witnesses and jurors.
